This information is provided to comply with article 13 of the European Regulation 679/2016 (GDPR). In compliance with current legislation, any operation concerning the personal data collected will be based on principles of correctness, lawfulness, and transparency.


By reason of the execution of the professional mandate, the Data Controller may process personal, identification, financial, particular and judicial data of the interested party, his family members and / or collaborators, and other subjects whose personal data he will confer for reasons relating to the protection of your rights.


The treatment will be carried out electronically and on paper for the following purposes:


1. Fulfilment of the defence, assistance or consultancy mandate specifically conferred.
2. Fulfil legal obligations in fiscal, tax, accounting, and to comply with the requirements dictated by the anti-money laundering legislation.
3. Process the data provided by the user by filling in the appropriate contact form in order to respond to the request for contact / information expressly formulated.

LEGAL BASES FOR THE PROCESSING


• The legal basis that makes the processing referred to in points 1 legitimate is the fulfilment of contractual and pre-contractual obligations deriving from the conferral of the professional mandate as well as the need to ascertain, protect and defend a right of the data subject in court.
• The legal basis that makes the processing referred to in point 2 legitimate is the fulfilment of legal obligations.
• The legal basis that makes the processing referred to in points 3 legitimate is the request expressly formulated by the interested party.


NATURE OF THE TREATMENT

The provision of data for the fulfilment of the professional mandate is necessary to perform the assigned task. Any refusal will make it impossible to execute the professional mandate.

The provision of data for contact requests is mandatory and any refusal to provide them will make it impossible to respond.

COMMUNICATION OF PERSONAL DATA

The data provided for reasons relating to the fulfilment of the professional mandate may have access:

• The employees of the Firm as internal data processors, specially trained by the Owner
• Colleagues and study collaborators

and may be communicated to

• Bodies of Justice
• Financial Information Unit (UIF) in compliance with anti-money laundering regulations
• Public Authorities
• Experts, technicians, consultants

for the performance of judicial and extrajudicial tasks conferred, as well as to any external data processors appointed.

The data provided for the purposes relating to the response of contact requests may only be accessible to the employees in charge and to the study collaborators.

The data provided will in no case be disseminated.

TRANSFERS OF PERSONAL DATA

The data collected could be transferred to third countries outside the European Union to foreign judicial authorities, colleagues, collaborators, experts, technicians and consultants, only when this is necessary to ascertain, exercise or defend a right of the interested party in court. , or when this is necessary to execute the professional mandate conferred.

PERIOD OF CONSERVATION

Personal data processed for reasons related to the fulfilment of the professional mandate will be kept for the entire duration of the same, and in any case, until the interested party requests a return if there is only a pre-contractual relationship.

In the event of a contractual relationship, the data collected will be kept for the period in which the asserted right is prescribed, and in any case for as long as necessary to fulfil the obligations dictated by the tax and accounting legislation.

The data collected following the contact request of the interested party will be kept until the request is processed.

RIGHTS OF THE INTERESTED PARTY

The interested party has the right to exercise the rights referred to in Articles 7, 15-22 of the European Reg. 679/2016.

For processing based on consent, the interested party has the right to revoke it at any time by contacting the Data Controller or Data Protection Officer at the addresses indicated below. The interested party, according to the same operating procedures, then has the right to obtain from the Data Controller confirmation of the existence or otherwise of their personal data and their availability in an intelligible form; has the right to request access to personal data concerning him, receive the personal data provided to the Data Controller and transmit them to another Data Controller without impediments (so-called portability); obtain the updating, limitation of processing, rectification of data and the cancellation of those processed in breach of current legislation.

The interested party also has the right, for legitimate reasons, to object to the processing of personal data concerning him and to the processing for the purpose of sending advertising material, direct selling and for carrying out market research. You also have the right to lodge a complaint with the Privacy Guarantor as the supervisory authority for the protection of personal data.
